1. Platform Purpose

Aescleon is a logistics and operational coordination platform designed for use by surgeons, medical device vendors, and other authorized professionals. The platform exists solely to support scheduling visibility, equipment coordination, availability planning, and operational communication.

Aescleon is not a medical record system, electronic health record (EHR), clinical documentation system, or patient communication platform.

2. Prohibited Use of PHI

Users agree that Aescleon must not be used to create, transmit, store, upload, or discuss Protected Health Information ("PHI") as defined under the Health Insurance Portability and Accountability Act (HIPAA).

PHI includes, but is not limited to:

  • Patient names
  • Medical record numbers (MRNs)
  • Dates of birth
  • Diagnoses
  • Clinical notes
  • Images or attachments containing patient-identifiable information

Any entry of PHI constitutes user misuse and is not an intended or permitted use of the platform.

3. Permitted Operational Data

Users may enter and view logistics-only operational data, including:

  • Surgery date and time
  • Facility or hospital name
  • Surgeon or provider name
  • Vendor or organization name
  • Equipment requirements
  • Surgery type or procedure category, solely for medical device and equipment logistics planning

Surgery type must be limited to a high-level procedural category and must not include patient-identifying or clinical detail.

4. User Responsibility

Users are responsible for ensuring their use of the platform complies with applicable laws, professional obligations, and organizational policies. Aescleon does not validate the legality of external data users already lawfully possess.

5. Enforcement

Aescleon may remove content, restrict access, suspend, or terminate accounts if misuse or prohibited use is identified.

6. No Business Associate Relationship

Because Aescleon does not process PHI during the MVP phase, Aescleon is not acting as a Business Associate under HIPAA.

7. Limitation of Liability & Indemnification

Users agree to indemnify and hold harmless Aescleon from claims arising from misuse of the platform, including prohibited PHI entry.
